Petition. In 1793 Francis, son of James Vaughan became his overseer at a verbal agreement to be paid 30£ per year. He took care of James Vaughan in 1793 and 1794. James Vaughan later died. Answer of Mary dated 25 July 1805. Deposition of Joshua Chaffin 8 Jan 1806. Deposition of Wilks Vaughan: James said none of the children by his first wife should be given anything except for Francis. A slave should be given Francis as his proportion of his grandfather Hill’s estate. Deposition of William Burton 15 Jan 1806: Milton Vaughan, agent for the Administratrix. Deposition of John Mitchell dated 15 Jan 1806: mentions division of the estate of Ann Vaughan, wife of James. Francis, then a minor had objected. All were of age except Wilkes Vaughan and Francis Vaughan. All agreed to the division except Francis. Will of James Vaughan: life estate to Mary, daughter Obedience Mitchell, and children James, Wilkes, Francis and Nancy Haskins have been provided for in their grandfather Hill’s estate and shall not receive anything. Observation: This set of chancery cases is a great lesson in the laws of inheritance of early Virginia. First, the widow sought and received dower property. Then the seven children of Robert Vaughan divided up his estate. So far this is all very straight forward. Then one of the children died without being married or having children. His six siblings by their father Robert were allocated equal shares of his real estate. Personal property (i.e. slaves) follows different rules. First, the mother is entitled to a child’s share. Second, half siblings that are children of the mother, but not the father each are allocated a half share. In this case the mother had a child by a prior marriage. When Benjamin died his half sister Jane received a half share Benjamin R. Vaughan a child of Robert Vaughan died while a minor owning 176 acres. Consent decree dividing Benjamin’s share of land into six parts to each of his siblings. Each received $294.50 2/3. Slaves were divided into fifteenths with the mother Sarah and each of the sibling receiving 2/15 and Jane H. Vaughan receiving a 1/15 share. Jane H. Vaughan was entitled to 1/15 of the share as a sister of the half blood by their mother Sally Vaughan and each of the others were entitled to 2/15 share. [Note: She was Jane H. Craddock, daughter of William? Craddock, deceased. She married James Vaughan who is not a descendant of Robert Vaughan. See Amelia Co. Chancery Case 1800-025] |

Sarah Vaughan died in 1839, leaving a will dated 9 May, 1839, proved 15 June 1841. Sarah Vaughan was married first to William Craddock and who had a daughter Jane H. who married James Vaughan, late of Nottoway County. Jane remarried Richard H. Jenkins. In her will Sarah gave a bequest to Albert G. and then directed her estate be divided between her 6 children. The plaintiffs interpreted this to mean the four plaintiffs, defendant Robert T. Vaughan and Baskerville Vaughan of Alabama (and to not include Jane). Her estate included property she owned outright and also a large dower estate. Asked that Baskerville Vaughan be made a defendant. The will was witnessed by Henderson F. Vaughan and Richard E. Farrer. This file only has the petition and the will without any action by the Court. |

Will of Asa Vaughan was admitted in July Term 1820. He directed that his estate be kept together until his eldest son James P. Vaughan arrived at 21. Then the shares of his other sons and daughters would be given to them as they each reach age 21. In November Court 1828 a “friendly suit was brought by some of the heirs for their legacies. Egbert G. Leigh appeared as guardian of Elsa Amanda Vaughan. All of the defendants answered that they were satisfied with prior distributions or would be happy with whatever the Court decided. Will dated 28 Apr 1820 is included in the file. Second son John Robert Vaughan, fourth son Henderson Fitzgerald Vaughan, third son Algernon Sidney Vaughan. Algernon Sidney Vaughan of Greene County, Alabama named James P. Vaughan as his attorney in fact on 21 Oct 1839. Codicil to will dated 7 May 1820. Court Order 28 Dec 1839 allocated the remaining estate into three equal parts to Henderson F. Vaughan, Elsa Amanda Vaughan and the Estate of Judith Frances Vaughan. |
